Enterprise Products Prevails in Battle Over Firing After Surgery

A former Enterprise Products Co. supervisor failed to overcome evidence that he was fired because of his poor performance and can’t prove his leave for gastric bypass surgery really drove his termination, the Fifth Circuit ruled.

Lance Royall was put on a performance improvement plan a few weeks after returning to work from a shoulder injury, the court said. He was approved for leave under the Family and Medical Leave Act about three weeks later for gastric bypass surgery, and six days after that he was told he was making insufficient progress under the PIP, the court said.
